INDEMNITY INSURANCE FOR OFFICIAL ACTIONS OF THE BOARD

Because they are members of an agency of government whose powers and duties can only be exercised by a decision of the majority of the whole five-member Board when it is officially in session, it shall be the policy of the Board that members of the Board and the administrators, staff and teachers of the Jefferson County School System shall not be placed in a position of personal individual liability for the performance of the responsibilities vested in them by the voters of Jefferson County whenever they act as agents of the Board.

Therefore, in order to protect the individual members of the Board, its agents, and the educational interests of the county represented by decisions of the majority of the whole of the five-member-Board, the Board shall purchase, in the absence of governmental immunity, or in addition to governmental immunity, from public school funds adequate insurance to indemnify Board members and agents of the Board for their official actions in the service of Jefferson County.
