DISPOSAL OF OBSOLETE, UNUSED OR SURPLUS LAND

Because the Board holds public property in trust and wishes to exercise that trust to the utmost, when the Board deems certain land to be obsolete for the purpose of public education, or if the Board otherwise deems it beneficial for public education, it may sell that surplus real estate. When the Board sells any real estate within its jurisdiction, sales shall be transacted in the following manner:

1. Upon advice of the Superintendent's IIC, other professionals, and the Board's attorney, the superintendent shall recommend that surplus property be sold by the Board.

2. All realty proposed to be sold by the Board shall be appraised and its fair market value established in a lawful manner by independent appraisers. The Board may then decide whether it wishes to proceed with the sale. Optionally, the Board may place a minimum acceptable price which may be higher than the appraised value, then proceed with the sale.

3. Following the Board's decision to offer such property for sale, the property shall be advertised by legal notice in the appropriate newspapers, which advertisements shall request bids on the advertised property.

4. The Board shall post customary signs on the property at various locations giving notice to adjacent land-owners that the property is for sale.

5. Sealed bids shall be received in a procedural manner to be prescribed and the property shall be sold to the highest bidder provided the high bid is at least as much as the minimum price acceptable by the Board.

6. In the event the property is not sold by bid after reasonable efforts have been made to obtain sale by competitive sealed bids, upon recommendation of the superintendent, a realtor may be employed or contracted to effect a sale.

7. It shall be the responsibility of the Board to provide a title binder and the appropriate warranty for any property it sells.
