POSSESSION OF GUNS BY STUDENTS

In compliance with the federal Gun-Free Schools Act (GFSA), the Jefferson County Board of Education expressly prohibits the possession of weapons by students at school or any setting that is under the control and supervision of the Board or its agents.

For the purpose of this policy, certain definitions shall apply.

1. Weapon - a firearm as defined in Section 921 of Title 18 of the United States Code, including the following:

- any weapon which will or is designed to or may readily be converted to expel a projectile by the action of an explosive

- the frame or receiver of any weapon described above

-any firearm muffler or firearm silencer

-any explosive, incendiary, or poison gas

1. bomb

2. grenade

3. rocket having a propellant charge of more than four ounces

4. missile having an explosive or incendiary charge of more than one-quarter ounce

5. mine

6. similar device

- any weapon which will, or which may be readily converted to, expel a projectile by the action of an explosive or other propellant.

- any combination of parts either designed or intended for use in converting any devise into any destructive device described in the two immediately preceding examples, and from which a destructive device may be readily assembled.

Any student who brings a weapon to school or school related functions shall be expelled for not less than one calendar year.

 

The GFSA does not define expulsion; however, at minimum, expulsion means removal from the student's current school. The Superintendent shall have sole authority to modify expulsions on a case-by-case basis. The Department of Student Services shall administer the expulsion in accordance with the provisions of the Code of Student Conduct.

Principals shall immediately refer any student so charged to the criminal justice or juvenile delinquency system. Concurrently, he/she shall also file a report with the Department of Student Services, which in turn shall forward copies to the Law Enforcement Liaison Officer, the appropriate Area Superintendent and the Superintendent.

Under no circumstances shall school principals fail to comply with the provisions of this policy. Negligence in following the policy will place in jeopardy the school system's receipt of federal funds. Failure on the part of any employee to fulfill his/her responsibilities relative to this policy shall be reflected in the assessment and evaluation process or in other forms as may be directed by the superintendent.
