OUT-OF-DISTRICT TUITION CHARGES
Recognizing that some communities may overlap beyond the jurisdiction of the Jefferson County Board of Education and incorporate parts of other county or city school systems, it is the desire of the Jefferson County Board of Education to establish and maintain bilateral attendance agreements with neighboring school districts under applicable statutes and other laws.
Although it is the responsibility of the respective boards of education to provide for the educational needs of the students within their jurisdiction, the Jefferson County Board of Education will accept out-of-district students based on a release from the respective boards of education, and a reasonable fee will be imposed which would bear some relation to the estimated annual per student cost of providing an education for a comparable student residing within the boundaries of the Jefferson County School district.
When a student who resides in an area served by another county or municipal school district is enrolled in a Jefferson County School without having paid appropriate tuition or without having met other applicable conditions or requirements, the student shall be withdrawn from school. Recovery of unpaid out-of-district tuition may be undertaken by such reasonable and lawful means as are deemed necessary and appropriate under the circumstances.
Subject to the requirements of any binding court order, no unauthorized out-of-district student shall be involuntarily withdrawn or removed from a Jefferson County School solely by reason of his or her out-of-district status during the last six weeks of an academic term (semester). However, this provision shall not absolve the parent(s) or legal guardian(s) of responsibility for payment of tuition charges, the liability for which shall continue to accrue for so long as the child is enrolled in a Jefferson County School.
Qualified students with disabilities who can, with minor adjustments, be provided an appropriate education shall not be discriminated against with respect to imposition of out-of-district tuition charges, nor shall extra fees be charged to qualified students with disabilities except where an additional charge is justified by a substantial increase in costs to the district incurred as a result of admitting such students.
