WRITTEN BOARD CONTRACTS
One of the primary objectives of the Jefferson County Board of Education is the protection of the public interest. That interest can best be protected when commitments between the Board and other parties are documented and mutually clarified in properly executed contracts.
When a written agreement is necessary to fulfill or obtain an obligation on behalf of the Board, and when the written agreement must be recorded in the minutes of the Board, the Department of Policy and Contractual Services, in cooperation with the Board attorney's office, will prepare or review and recommend proper written agreements with the various departments, schools, and outside persons or agencies.
When the acquisition of property is involved, contracts will be prepared after resolutions have been adopted by the Board and spread upon its minutes (CODE OF ALABAMA, 16-8-40). The resolutions will include a written form to be used for general contracting services, and will grant proper authority and responsibility to the appropriate agent or agents of the Board. Agreements made by such forms will be subject to the approval of the Board and, when appropriate, the superintendent or the superintendent's designee. The Department of Policy and Contractual Services will assist in the preparation, review and recommendation of the enabling resolutions.
If an agreement is drawn by another party and submitted to the Board for approval, it will be reviewed through the process stated above.
Upon request, the Director of the Department of Policy and Contractual Services will assist Board personnel in the negotiations of an agreement.
