BOARD OF APPEALS ON ALL SCHOOL MATTERS

In order to assure all students served by the Jefferson County Board of Education and all of the Board's employees that all due process rights shall be observed in any problem concerning the students or the employees of the Jefferson County School System, the Board shall act as the board of appeals in such matters so that equitable solutions for the problems can be reached.

Many such problems can be resolved through the use of the Board's "problem-solver" form. The use of this form of appeal is procedurally defined in JCBE/POLICY FILE: 533.7, Grievance Procedures.

However, there are other matters of appeal which have been specifically delegated to the Board. The Board, in accordance with public school law, shall serve as the board of appeals in these matters:

1. Matters of appeal concerning the assignment, transfer, and continuance of students. It should be noted here that this is a judicial power in matters of appeal only. The authority for the performance of assignment, transfer, and continuance of students, in accordance with public school law, has been delegated by the Board through the superintendent to the Department of Student Services.

2. Matters of appeal concerning the transfer of teachers on continuing service status. (CODE OF ALABAMA, 16-24-6)

3. Matters of appeal concerning the non-renewal of contracts with teachers on continuing service status.
