POWERS GRANTED BY LAW WHICH ARE TO BE EXERCISED BY

THE SUPERINTENDENT OR WITH THE COUNSEL OF THE SUPERINTENDENT

In accordance with state statutes (CODE OF ALABAMA, 16-8-9), the Board shall exercise control and supervision of the Jefferson County School System through its superintendent and his professional assistants.

Duties required by state Law which are to be exercised by the Board through its superintendent are as follows:

1. The Board shall appoint, upon the written recommendation of the superintendent, all principals, teachers, clerical and professional assistants authorized by the Board. In accordance with the provisions of the Teacher Tenure Act and Act 83-644, the Board shall also suspend or dismiss any employee or appointee for immorality, misconduct in office, insubordination, incompetency, willful neglect of duty, or whenever the best interest of the school system requires suspension or dismissal.

2. The Board shall, upon the written recommendation of the superintendent, prescribe courses of study for the schools under its jurisdiction, and shall supply to every teacher and every interested citizen of the county a printed copy of these courses of study.

3. The Board shall, upon the written recommendation of the superintendent, grade and standardize all of the schools under its jurisdiction (CODE OF ALABAMA, 16-8-29).

4. The Board, subject to rules and regulations of the State Board of Education, shall cause to be taken, under the direction of the superintendent, an octennial school census of the children of the county between the ages of six and nineteen, inclusive (CODE OF ALABAMA, 16-8-31).

5. The Board shall, upon the written recommendation of the county superintendent, determine and establish a written educational policy for the county and shall prescribe the rules and regulations for the conduct and management of the schools (CODE OF ALABAMA 8-10).

Duties required by public school law which are to be exercised by the Board with the counsel of its superintendent are as follows:

1. The Board shall, upon recommendation of the superintendent, set boundaries for the county school system to be divided into one or more appropriate and-convenient compulsory school attendance districts. The Board shall keep full and complete records of the boundaries thereof, and ensure that the compulsory attendance law is enforced (CODE OF ALABAMA, 16-8-34 and 16-28-3).

2. The Board shall, upon recommendation of the superintendent, prescribe the conditions on which students in the first six grades of elementary instruction may be admitted to junior high schools, and also the conditions upon which students in junior high schools may be admitted to senior high schools.

3. The Board shall, upon recommendation of the superintendent, prescribe forms and blanks on which all regular employees shall make reports required from them by the Board (CODE OF ALABAMA, 16-8-38).
