ELECTION PROCEDURES FOR BOARD MEMBERS

To maintain continuity in the policy-making agency of the Jefferson County School System, members of the Board shall be elected at the general election of state and county officers to staggered, six-year terms. In compliance with the election Laws of the State of Alabama, each Board member, whether newly elected or re-elected, must subscribe to the following procedures:

1. The members of the Board shall hold office until their successors have been elected and qualified. (CODE OF ALABAMA, 16-8-2)

2. Before exercising any authority or performing any duties as a member of the Board, each member shall qualify by taking and subscribing to the following oath of office:

"I, ______________, solemnly swear (or affirm, as the case may be) that I will support the Constitution of the United States, and the Constitution of the State of Alabama, so long as I continue a citizen thereof; and that I will faithfully and honestly discharge the duties of the office upon which I am about to enter, to the best of my ability. So help me God." (Article XVI, Alabama State Constitution; CODE OF ALABAMA, 16-8-2)

3. The oath may be administered by any officer authorized by law to administer an oath (Article XVI, Alabama State Constitution). The oath may be administered by a Jefferson County probate judge.

4. The certificate of election and qualification of a Board member shall be filed in the office of the Jefferson County probate judge (CODE OF ALABAMA, 16-8-2). The probate judge notifies the Secretary of State of the election results and the swearing-in of a Board member. The Secretary of State then issues a commission of election and qualification, which is in the form of a certificate.
